Foreign Investment in Thai Lottery: A Guide for Non-Residents

Foreigners can legally participate in the Thai lottery, but they must understand the structure and regulations governing ticket purchases.

The Thai lottery is widely accessible and allows foreigners to purchase tickets legally from licensed vendors within Thailand. This lottery is a popular form of gambling in the country, with regular draws taking place on the 1st and 16th of each month, with exceptions for major Buddhist holidays and specific public holidays. Notably, December sees three draws as part of its holiday tradition.

Each ticket is sold in pairs at a price of 80 baht per pair, featuring a unique six-digit number. In total, a single lottery set includes 1 million tickets, and successive Thai governments have sought to curb the practice of overcharging for tickets that carry auspicious numbers, achieving mixed results.

Prize Structure

The Thai lottery is structured with multiple prize tiers, distributing approximately 48 million baht among 14,168 winning tickets in each draw. The breakdown of prizes for matching six digits includes:

  • First Prize: 1 winner, receiving 6,000,000 baht
  • Second Prize: 5 winners, each receiving 200,000 baht
  • Third Prize: 10 winners, each receiving 80,000 baht
  • Fourth Prize: 50 winners, each receiving 40,000 baht
  • Fifth Prize: 100 winners, each receiving 20,000 baht
  • Consolation Prizes: 2 winners for numbers close to the first prize, each receiving 100,000 baht

In addition to these larger amounts, there are smaller prizes linked to the first and last digits of the ticket:

  • First 3 digits: 2,000 winners, each receiving 4,000 baht
  • Last 3 digits: 2,000 winners, each receiving 4,000 baht
  • Last 2 digits: 10,000 winners, each receiving 2,000 baht

Prize Claims for Foreigners

Foreigners who win the lottery must claim their prizes by presenting their passport or government-issued ID alongside their winning ticket. Key details for claiming include:

  • Deadline: Winnings must be claimed within 2 years from the draw date.
  • Claiming Locations: Major prizes can be collected at the Government Lottery Office in Bangkok, while smaller prizes may be claimed at regional lottery offices or through licensed agents.

Tax Obligations

Winners should be informed about the tax implications of lottery winnings in Thailand. The key points include:

  • Withholding Tax: Lottery winnings are subject to a 0.5% withholding tax.
  • Stamp Duty: A stamp duty fee of 1 baht applies for every 200 baht, or fraction thereof, of the prize amount.
  • Payment Options: Winners can opt to receive their prize in cash or through a cheque, particularly for larger sums.

For foreign nationals intending to transfer their winnings back to their home country, it is advisable to check local regulations regarding customs declarations and any potential tax obligations related to foreign income or lottery prizes.
