Thailand Intensifies Crackdown on Foreigners Misusing Student Visas for Illegal Employment
Government agencies collaborate to address the issue of foreign nationals using student visas to work illegally, particularly in construction sites
The Ministry of Higher Education, Science, Research and Innovation (MHESI) and the Immigration Bureau have joined forces to tackle the growing concern of foreign nationals exploiting student visas to bypass work permit regulations.
Reports have revealed that foreign workers, including Chinese engineers, are using student visas to work illegally on construction sites in Thailand.
Online platforms have highlighted operations in provinces like Lamphun, where student visas were allegedly renewed for a fee and used as a cover for nationwide illegal employment.The Minister of MHESI has ordered several universities, including those with Chinese investment, to provide full details on all Chinese students, including their programs enrolled, duration of study, and visa types.
The minister has also appointed her secretary to meet with immigration officials to discuss stricter measures to verify foreign students and ensure education visas are not misused for employment.Institutions found to be complicit or neglectful in allowing the misuse of student visas will face strict legal consequences.
The ministry aims to protect the integrity of Thailand’s higher education system and prevent it from becoming a loophole for illegal labor.
A centralized database for foreign students is being created, which will be used for cross-verification with immigration and other agencies.Policies for admitting foreign students, particularly into non-degree or short-term programs, are being reviewed and tightened.
Senior officials from MHESI and the Immigration Bureau have agreed to establish a framework for closer collaboration, including the provision of real-time data on international student visa approvals.
Universities offering non-degree programs will be required to submit detailed course outlines for ministry review.Using a student visa to work constitutes a violation of Thailand’s labor laws, except in cases where internships are part of the academic program.
The Department of Employment is investigating such cases and has encouraged the public to report suspicious activity.
Those caught working under a student visa without proper authorization will face legal consequences under Thailand’s Foreigners’ Working Management Emergency Decree.
